Request to the Committee for the Notification of Copyright and Related Rights Infringement on the Internet

A. If copyright or related rights are infringed on the internet, the rightholder may submit a request for the cease of the infringement to the Committee, deliver it personally or file it online (Procedure of par. 4 article 66E Law 2121/1993).

The procedure of submitting the request to the Committee is the following:

STEP 1. PAYMENT OF THE FEE

The fee required for the examination of the case amounts to:

  • 300 euros, if the application concerns one (1) domain name.
  • 500 euros, if the application concerns two (2) to five (5) domain names.
  • 700 euros, if the application concerns six (6) to ten (10) domain names.
  • 1000 euros, if the application concerns eleven (11) to fifty (50) domain names.
  • 1000 euros, if the application concerns the blocking of IP addresses that provide access to content through continuous streaming of data (live-streaming). Such requests may not include more than fifty (50) IP addresses.

The above costs do not include VAT.

The examination fee is deposited to the National Bank of Greece (code SWIFT(BIC) ETHNGRAA), in credit of the Hellenic Copyright Organization’s (HCO) bank account (IBAN GR8101101510000015129605323). A copy of the relevant payment receipt, mentioning the applicant’s full details, is submitted to the Accounting Department of the HCO. This fee constitutes a prerequisite of the commencement of the procedure and, as such, it may in no event (including the closing of the case) be reimbursed.

Please make sure that you have made payment of the fee before completing the application form.

STEP 2. FILLING IN THE ELEMENTS OF THE INFRINGEMENT

  • If your complaint concerns an infringement committed via website domain names:

    Download to your local disk and fill in the file domain_names_EN.xls. You will be asked to submit it during the completion of the application form.

  • If your complaint concerns the disabling of access to ip addresses that provide content via live streaming:

    Download to your local disk and fill in the file ip_addresses_EN.xls. You will be asked to submit it during the completion of the application form.

STEP 3. FILLING IN THE APPLICATION FORM

B. If copyright or related rights are infringed on the internet and upon,

a) An upcoming large scale online infringement of events of national or international viewing that are scheduled to be broadcasted live,

b) The infringement will take place indicatively via certain URL or IP addresses or domain names that provide internet access without a subscription to internet services by any means but mainly through the use of codes or a decoder and,

c) An urgent case of preventing an imminent, serious and upcoming danger or irreparable damage for the public interest or the rightholder,

the right holder may submit a request to the Committee for the disabling of access, either deliver it personally or file it online. (Procedure of par. 4 article 66E l.2121/1993)

  • If your complaint concerns an infringement that takes place via domain names that provide internet access without a subscription to internet services by any means but mostly through the use of codes or a decoder:

STEP 3. FILLING IN THE APPLICATION FORM

Deadline for submitting the request of par. 10A article 66E l. 2121/1993

The rightholder’s application is submitted to the Committee at least fifteen (15) working days before the scheduled broadcast of the event. In case the application concerns more than one event, it is submitted at least 15 working days before the scheduled broadcast of the chronologically first national or international event.

Submission of supplementary evidence

In case that the rightholder submits to the relevant department of EETT, with a notice to the Committee, supplementary evidence regarding the infringement of the decision or the recurrence of the infringement, according tο subpar. 2c of par. 10A Law 2121/1993, this should include the filled-in form of supplementary evidence of the file sympliromatiki_10A_en.xlsx.
